Practice Experience

  • Mr. Collins is a member of the firm’s Business Litigation & Trade Regulation Practice Group as well as the firm’s Franchise & Distribution Law Practice Group.
  • Mr. Collins' practice principally focuses on Business Litigation and Trade Regulation, with an emphasis on franchise and distribution law and state and federal franchise law compliance.  He represents both franchisors and franchisees in all aspects of a franchise relationship, from initial negotiations and contract formation to the winding down or termination of a franchise agreement.  He also represents franchisors with the enforcement of post-term covenants not to compete, trademark protection, and other injunctive relief.
  • Mr. Collins provides full-service franchise legal compliance programs that include the structuring, registration and updating of franchise disclosure documents throughout the United States.  He prepares of all the required federal and state-specific disclosure provisions and drafts all the contracts necessary to establish, protect, and enforce franchised business relationships.  Mr. Collins maintains the on-going disclosure, reporting and registration renewal needs of clients in strict compliance with all the federal and state laws that govern their franchise, distributor and dealer relationships.
  • While attending the Georgetown University Law Center, Mr. Collins participated in an externship at the headquarters of the Securities & Exchange Commission where he assisted in financial investigations of large global conglomerates and analyzed financial statements of major companies in search of complex, illicit financial behavior.  Mr. Collins was also a member of the Black Law Students Association and the Corporate Law Association during law school.

Representative Matters

  • Represented clinical laboratory employer in state court action against former employees arising from employees arising from employees' breach of contract and violations of in-term covenants not to compete. Obtained a temporary injuction on behalf of employer which prohibited former employees from contacting or soliciting employer's customers and employees and from competing against employer within a particular territory.
  • Represented restoration services franchisee in intra-franchise arbitration against a sister franchisee which continually infringed upon the client's protected territory.
  • Represented petroleum products and services company in state court action brought by Fortune 500 petroleum wholesaler alleging breach of contract.
  • Represented foreign-owned franchisee in state court action brought against franchisor seeking to rescind the franchise agreement and to recover damages due to various violations of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) and the Florida Franchise Act (FFA), negligent misrepresentation, and fraudulent inducement.
  • Represented national retail licensor in state court action arising from commercial landlord's breach of contract, negligent misrepresentations and fraudulent inducement of licensor into commercial lease.
  • Represented retail pharmacy franchisor in providing a full-service franchise legal compliance program that includes the structuring, registration and updating of franchise offering and disclosure documents throughout the United States.
  • Represented multi-state licensor and its president in state court action brought by licensee claiming that the licensor's business arrangement constituted a franchise and that the licensor failed to comply with state and federal franchise laws.
  • Represented franchisee in federal court action to enforce post-judgment collections against multi-state franchisor.
  • Represented master franchisee of an office supply company in a dispute with a Florida franchise concerning issues involving system standards, training, system support, and royalties.
  • Represented first time franchisee in negotiations with an international franchisor to open the inaugural franchise within the State of Florida.
